Terms of Use

1. Agreement to these Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Service. We refer to CardForecast as “we,” “us,” or “our,” and to you as “you” or the “user.”

2. The Service

CardForecast is an informational analytics platform for the Pokémon Trading Card Game. We aggregate and present third-party market data — including prices, price history, sales activity, graded-card values, and derived metrics such as liquidity, volatility, and risk scores — to help collectors and enthusiasts research cards and sets. The Service is provided for general informational and research purposes only.

3. Not financial, investment, or trading advice

Nothing on the Service constitutes financial, investment, tax, legal, or trading advice, or a recommendation to buy, sell, or hold any trading card or other asset. Trading cards are collectibles whose value can be volatile and is not guaranteed. Our prices, scores, and projections are estimates derived from third-party data and automated models; they may be inaccurate, incomplete, or out of date. Any decision you make based on the Service is made solely at your own risk, and you should conduct your own research and consult a qualified professional where appropriate.

4. Eligibility

You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to purchase any paid subscription. By using the Service you represent that you meet these requirements and that your use complies with all applicable laws.

5. Accounts

Some features may, now or in the future, require you to create an account. When account features are available, you agree to provide accurate and complete information, to keep your credentials confidential, and to be responsible for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Subscriptions, billing, and payments

We may offer paid plans that unlock additional features (“Subscriptions”). The following terms apply if and when you purchase a Subscription:

• Payment processor. Payments are processed by our third-party payment provider, Stripe. By subscribing, you agree to Stripe’s terms and authorize us and Stripe to charge your selected payment method. We do not store your full card number or other complete payment-card details on our servers; that information is handled by Stripe.
• Recurring billing & auto-renewal. Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) and automatically renew for successive periods at the then-current price until cancelled.
• Cancellation. You may cancel your Subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.
• Refunds. Except where required by law, payments are non-refundable and partial periods are not prorated. We may, at our discretion, offer refunds or credits in individual cases.
• Price changes. We may change Subscription prices or plan features. We will give reasonable advance notice of price increases, which take effect on your next renewal; continuing to use a paid plan after the change constitutes acceptance.
• Taxes & failed payments. Prices exclude applicable taxes unless stated otherwise. If a payment fails, we may retry it and suspend or downgrade paid features until payment is resolved.

7. Changes to the Service

We are continually developing the Service and may add, modify, suspend, or discontinue any feature (including free or paid features) at any time. We are not liable to you for any such change, provided that for paid features we act consistently with Section 6.

8. Acceptable use

You agree not to:

• scrape, crawl, harvest, or systematically extract data from the Service, or use bots or automated means to access it, except as expressly permitted;
• resell, redistribute, sublicense, or commercially exploit the Service or its data without our written permission;
• reverse engineer, decompile, or attempt to derive source code or underlying models, except where such restriction is prohibited by law;
• interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure, or attempt to gain unauthorized access to it;
• misrepresent your identity, infringe others’ rights, or use the Service for any unlawful purpose.

9. Intellectual property

The Service, including its design, text, software, charts, and original compilations and analytics, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

“Pokémon” and all related names, marks, and card images are trademarks and copyrights of Nintendo, Creatures Inc., and GAME FREAK Inc. CardForecast is an independent project and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, TCGplayer, eBay, or any card grading company. All such marks belong to their respective owners.

10. Third-party data and services

The Service relies on data and services from third parties, including marketplaces and pricing sources such as TCGplayer and eBay. We do not control and are not responsible for the accuracy, availability, or practices of third-party sources, and their data may change without notice. Links to third-party sites are provided for convenience and do not imply our endorsement.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF PRICING DATA, SCORES, OR OTHER CONTENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING ANY DECISIONS MADE IN RELIANCE ON ITS DATA. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND (B) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless CardForecast and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 9–13) will survive.

15. Governing law & disputes

These Terms are governed by the laws of [Jurisdiction — to be specified by the operator], without regard to conflict-of-laws rules, and the courts located there will have exclusive jurisdiction over any disputes, except where applicable law gives you the right to bring proceedings elsewhere.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
